1. Acceptance of Terms

By accessing or using PlantHelp ("Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

PlantHelp is an AI-powered plant care platform offering plant identification, disease diagnosis, pest identification, care scheduling, and a community care guide library. AI-generated recommendations are informational only and are not a substitute for professional horticultural or agricultural advice.

3. Eligibility

You must be at least 13 years old to use this Service. By using PlantHelp you represent that you meet this age requirement. Users under 18 must have parental or guardian consent. We do not knowingly collect data from children under 13.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

5. Subscriptions, Auto-Renewal & Billing

PlantHelp Premium is a paid, automatically renewing subscription service. Please read this section carefully before subscribing.

5.1 Subscription Plans & Pricing

  • Monthly Plan: $4.99 USD per month, billed every 30 days.
  • Annual Plan: $39.99 USD per year, billed once per year.
  • All prices are in US Dollars. Applicable local taxes (VAT, GST, sales tax) may be added at checkout.

5.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annual) at the then-current rate, and your payment method on file will be automatically charged, unless you cancel before the renewal date.

You authorize PlantHelp (via its payment processor, Stripe) to charge the payment method associated with your account for each renewal period without further action from you.

5.3 How to Cancel

You may cancel your subscription at any time by: (a) visiting Settings → Subscription within the app, or (b) emailing support@planthelp.org. Cancellation must be completed at least 24 hours before your next renewal date to avoid being charged for the next period. After cancellation, you retain access to Premium features through the end of the current paid period.

5.4 Refund Policy

All subscription payments are non-refundable, including for unused portions of a billing period, except where required by applicable law. We may grant refunds at our sole discretion for documented technical failures that prevented access to the Service.

5.5 Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increase before your next renewal date. Your continued subscription after notice constitutes acceptance of the new price.

5.6 Free Trials

If we offer a free trial, your payment method will be charged at the end of the trial period unless you cancel before the trial ends. Trial duration and terms will be stated at the time of enrollment.

6. User Content

You retain ownership of content you upload (photos, plant data, care notes). By uploading content, you grant PlantHelp a non-exclusive, royalty-free, worldwide license to use, store, and display that content solely to provide the Service.

You agree not to upload content that is illegal, abusive, infringing, or otherwise objectionable. We reserve the right to remove content that violates these Terms.

7. AI Disclaimer

PlantHelp uses AI to generate plant care recommendations, diagnoses, and identifications. AI output is provided for informational purposes only. It may not be accurate in all cases. We make no warranties regarding the accuracy or completeness of AI-generated content. Do not rely solely on AI output for critical plant care, agricultural, or health decisions. Always consult a qualified professional when in doubt.

8. Intellectual Property

All content, trademarks, and software comprising the PlantHelp platform — excluding user-uploaded content — are owned by or licensed to PlantHelp. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Scrape, crawl, or copy data from the Service without permission
  • Attempt to access accounts, systems, or networks without authorization
  • Transmit malware, spam, or harmful code
  • Use the Service in a manner that could damage, disable, or impair it
  • Resell or commercially exploit the Service without our consent

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANTHELP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless PlantHelp and its affiliates from any claims, damages, losses, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law provisions. You agree to submit to the personal jurisdiction of the courts located in Colorado for the resolution of any disputes.

For EU/UK residents: nothing in these Terms limits your right to bring claims before your local courts or competent regulatory authority under applicable consumer protection laws.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time via Settings. Upon termination, your right to use the Service ceases immediately.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms with an updated date and, where required by law, via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance.
